CapContracts
Terms of Service
Last updated: October 22, 2026
1. Parties and scope
These terms of service (hereinafter "Terms") govern the relationship between CapContracts (hereinafter "we"), a federal public procurement advisory firm, and any person or business (hereinafter "the Client") that retains our services.
By engaging our services, the Client acknowledges having read these Terms and accepts them in their entirety.
2. Nature of services
CapContracts provides advisory, support and monitoring services in Canadian federal public procurement. Our services include in particular:
- Registration on government platforms (SAP Ariba, CanadaBuys, CPSS, etc.);
- Monitoring and delivery of relevant tender notices;
- Opportunity analysis and strategic guidance;
- Bid review (The Lynx Eye service).
Our services are advisory in nature. We act as consultants and do not make business decisions on behalf of the Client.
3. No guarantee of results
CapContracts does not guarantee the award of a government contract. Contract award rests exclusively with the relevant federal authorities and depends on many factors beyond our control, including:
- The evaluation criteria specific to each tender notice;
- The competitiveness of the Client's price and proposal;
- Procurement policies in effect;
- The discretionary decisions of federal departments and agencies.
Our advice aims to maximize the Client's chances, but does not imply any promise of success.
4. Client responsibilities
The Client is responsible for:
- The accuracy of the information they provide to us;
- Decisions made on the basis of our advice;
- Compliance with legal and regulatory requirements applicable to their sector of activity;
- The final content of any bid submitted to a government authority.
5. Confidentiality
We treat information shared by the Client with discretion and do not disclose it to third parties without consent, except as required by law. The Client acknowledges that information transmitted via our online forms is processed in accordance with our privacy policy (forthcoming).
6. Payment and termination
Payment terms are agreed upon at the time of service engagement (Interac e-Transfer or other agreed means). Unless otherwise stipulated:
- Activation fees are non-refundable;
- Monthly service packages may be terminated with 30 days' notice;
- Any service already rendered remains due at the time of termination.
7. Limitation of liability
To the extent permitted by applicable law, CapContracts shall not be liable for any loss of revenue, contracts, business opportunities or any other indirect damages arising from our services or the use of our advice.
Our total liability to the Client shall in no event exceed the amount of fees paid during the three (3) months preceding the event giving rise to the claim.
8. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the competent courts of Quebec.
9. Modifications
CapContracts reserves the right to modify these Terms at any time. Modifications take effect upon publication on this site. It is the Client's responsibility to regularly review the Terms.
